Consumer Protection & Toxic Torts
We have considerable experience prosecuting violations of consumer protection laws, including claims brought under the California Consumers Legal Remedies Act (the “CLRA”) (e.g., for automatic renewal law violations and phantom price discounts), the Telephone Consumer Protection Act, 47 U.S.C. § 227 (the “TCPA”), California’s Proposition 65 (the Safe Drinking Water and Toxic Enforcement Act of 1986, e.g., Health & Safety Code § 25249.6), and the California Unruh Civil Rights Act (Cal. Civ. Code, §§ 51, et seq.).
In addition to prosecuting numerous California Proposition 65 enforcement suits— including cases involving toxic exposures to Anabolic Steroids, Androstenedione, Phenazopyridine Hydrochloride, Cocamide DEA and Marijuana Smoke—and hundreds of consumer-driven clams (e.g., cases brought under California’s CLRA, the federal TCPA, California’s “anti-spam” email statute, and the California Unruh Civil Rights Act), examples of our recent successes include:
September 2023: obtained high six-figure individual settlement on behalf of homeowners alleging exposure to benzene (Contra Costa County Superior Court).
September 2023: $1.8 million classwide settlement on behalf of 122 FBI Supervisory Investigative Specialists (U.S. Court of Federal Claims in Washington, D.C.).
July 2023: as plaintiff’s counsel, obtained court-approved consent judgment in Cal. Proposition 65 case involving toxic exposures to Cocamide DEA (Los Angeles County Superior Court).
May 2023: obtained favorable nuisance value settlement for aviation company in Cal. Proposition 65 case alleging exposures to Diisononyl phthalate (Alameda County Superior Court).
October 2022: obtained first (and only) court-approved consent judgment in Cal. Proposition 65 case involving toxic exposures to Phenazopyridine Hydrochloride (Los Angeles County Superior Court).
June 2022: obtained $15 million classwide settlement, as plaintiff’s counsel, in TCPA class action (U.S. District Court for the Middle District of Florida).
