Consumer Protection & Toxic Torts
We have considerable experience prosecuting violations of consumer protection laws, including claims brought under the California Consumers Legal Remedies Act (the “CLRA”) (e.g., for automatic renewal law violations and phantom price discounts), the Telephone Consumer Protection Act, 47 U.S.C. § 227 (the “TCPA”), California’s Proposition 65 (the Safe Drinking Water and Toxic Enforcement Act of 1986, e.g., Health & Safety Code § 25249.6), and the California Unruh Civil Rights Act (Cal. Civ. Code, §§ 51, et seq.).

Successfully reversing a judgment of dismissal in a California Proposition 65 case that alleged a muscle building compound contains a chemical known to cause cancer (Androstenedione) without the required Proposition 65 warning. (Stein v. Black Diamond Supplements (Cal. Ct. App., B308482)).
Currently prosecuting numerous California Proposition 65 enforcement suits, including cases involving exposures to Anabolic Steroids, Androstenedione, Phenazopyridine Hydrochloride, and Marijuana Smoke.
