Appeals 

In addition to being trial attorneys, we draw upon our federal appellate clerkship experience to serve as appellate counsel in a wide array of cases.  We have achieved success in appeals upholding favorable lower court rulings, as well as overturning adverse rulings.

The firm’s recent successes at appellate litigation include:

  • May 2023: obtained reversal in the California Court of Appeal of negligence claims against a private contractor retained by the California Public Utilities Commission (“PUC”) to administer a PUC program for providing free telephone services to low-income households (Cal. Ct. App., 1st Dist.).

  • September 2021: successfully dismissed an appeal from an order denying a motion for $273,484.56 in attorneys’ fees under Cal. Civil Code section 3426.4 (providing for attorneys’ fees for the bad faith prosecution of a trade secret misappropriation claim) (Cal. Ct. App., 2nd Dist.).

  • April 2021: successfully reversed a judgment of dismissal in a case that alleged a muscle building compound contains a chemical known to cause cancer (Androstenedione) without the warning required by Cal. Proposition 65 appearing on the packaging (Cal. Ct. App., 2nd Dist.).

  • December 2019: prevailed in complex appeal involving the misapplication of California Probate Code section 6402.5, a statute that provides the circumstances under which the portion of the decedent’s estate attributable to a decedent’s predeceased spouse may be distributed to certain relatives of the predeceased spouse (Cal. Ct. App., 2nd Dist.; handled by Mr. Cole prior to forming KJC Law Group, A.P.C.).
